Terms of Service

1. Introduction

Welcome to EALLIANCE! These Terms of Service (« Terms ») govern your use of the EALLIANCE mobile application and related services (« App ») operated by EALLIANCE SERVICES LTD, a company based in the United Kingdom. By accessing or using our App, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use our App.

2. Eligibility

You must be at least 18 years old to use the EALLIANCE App. By using the App, you confirm that you are legally capable of entering into this agreement. Access to certain features may be limited based on your location due to regulatory or compliance requirements.

3. Account and Security Responsibilities

You are responsible for safeguarding your account credentials, including your private keys, access codes, and PINs. We cannot recover or restore any wallets, accounts, or funds if your private keys are lost, misplaced, or compromised. You agree to:

  • Protect Your Private Keys: Store your private keys in a secure location that is not accessible to others. EALLIANCE does not hold or have access to your private keys.
  • Report Fraudulent Communications: Notify us immediately if you receive any suspicious or fraudulent communications that solicit your credentials or attempt to impersonate EALLIANCE. Note that we will never ask for your access codes, PINs, or private keys.

4. Intellectual Property and Licensing

EALLIANCE owns all intellectual property rights related to the App, including logos, trademarks, and proprietary software. By using the App, you are granted a limited, non-exclusive, non-transferable license to access and use the App for personal purposes only. You do not gain ownership or any rights to EALLIANCE’s intellectual property through use of the App.

5. Consent to Electronic Communication

By using the App, you consent to receive electronic communications from EALLIANCE, including updates, notices, agreements, and other communications. These communications fulfill any legal requirements for written communication.

6. Acceptable Use Policy

You agree to use the App only for lawful purposes and in compliance with applicable laws in the UK, EU, and target regions, specifically Benin and Ivory Coast. Prohibited activities include, but are not limited to:

  • Illegal or Fraudulent Activities: Engaging in any unlawful activities, fraud, or attempts to defraud others.
  • Hate Speech, Insulting, or Discriminatory Conduct: Participating in or promoting hateful, abusive, threatening, discriminatory, or otherwise harmful conduct within or in connection with the App.
  • Unauthorized Access and Security Violations: Attempting to bypass security measures, gain unauthorized access to any account, or disrupt the functionality of our App.
  • Other Prohibited Activities: Any activity that is harmful to EALLIANCE, other users, or third parties, including harassment, abuse, intimidation, or solicitation of sensitive information.

7. Non-Custodial Services

EALLIANCE is a non-custodial service provider. We do not hold, manage, or access your funds. Transactions are processed directly on the blockchain, and users maintain full control over their assets. You acknowledge that by using a non-custodial app, you are solely responsible for the security and management of your digital assets.

8. Transactions, Risks, and Liability

Our App allows you to interact with the blockchain to send, receive, convert, and cash out certain digital assets. Blockchain transactions are irreversible, and EALLIANCE cannot undo or refund transactions once they are initiated. By using this App, you acknowledge and accept the inherent risks of cryptocurrency activities, including but not limited to asset volatility, potential transaction delays, and the possibility of loss of funds.

EALLIANCE does not provide financial or investment advice, and any decisions to transact are made at the user’s discretion and risk. You are responsible for any legal or tax obligations arising from your activities within the App.

9. Compliance, Reporting, and Verification

To use our services, you must complete a Know Your Customer (KYC) verification. We are committed to implementing Anti-Money Laundering (AML), Countering the Financing of Terrorism (CFT), and other regulatory requirements relevant to the UK, EU, Benin, and Ivory Coast. This may involve verifying your identity, monitoring transaction activity, and reporting suspicious activities to appropriate authorities as required by law.

10. Data Storage and Processing

Your data is stored and processed securely within data centers in the EU, ensuring compliance with GDPR and UK data protection standards. We take all necessary steps to safeguard your data in accordance with these laws and any applicable international requirements.

11. Third-Party Services

Our App may facilitate access to third-party services that assist with transactions or other functionalities. EALLIANCE does not control these services and is not responsible for their performance, accuracy, or reliability. You agree that your use of any third-party services is at your own risk and subject to their terms and policies.

12. Termination of Service

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required by law or regulatory authorities. You may also terminate your account at any time. Termination of your account will not affect any rights or obligations that arose prior to termination.

13. Limitation of Liability

EALLIANCE provides the App on an « as-is » and « as-available » basis, without warranties of any kind, either express or implied. To the fullest extent permitted by law, EALLIANCE disclaims all warranties, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement. EALLIANCE is not liable for any loss of funds, data, or profits arising from your use of the App or your inability to access or use it.

14. Dispute Resolution and Governing Law

These Terms are governed by and construed in accordance with the laws of the United Kingdom. Any dispute arising from or related to these Terms shall be resolved through binding arbitration in the United Kingdom, subject to applicable arbitration laws, unless otherwise agreed by both parties.

15. Changes to Terms

EALLIANCE may update these Terms from time to time to reflect changes in our practices, legal requirements, or for other operational reasons. We will notify you of any significant updates and obtain your consent where legally required. By continuing to use our App after changes to these Terms are posted, you agree to be bound by the revised Terms.
